in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Foreign and Commonwealth Office (the ‘FCO’) is seeking to award a contract to The Royal Institute of International Affairs, Chatham House; using the negotiated procedure without prior publication — Regulation 33(1)(b)(ii) ‘competition is absent for technical reasons’.
FCO require an organisation to:
(a) lead; and
(b) programme manage, a coalition of UK and Chinese experts from across the areas of policymaking, research and business in the area of climate change and its impacts. The lead organisation is required to have:
(i) a proven track record of working with UK and current Chinese government officials and experts on climate risk and attendant issues up to director general level; and
(ii) proven convening, representational and programme management capabilities specially in the areas of policy research; and
(iii) a proven ability to work on sensitive and political issues, including but not limited to climate change issues, free from conflicts-of-interest or commercial interests.
