The UK MOD considers that this can be justified on the basis of technical grounds and/or exclusive rights pursuant to Article 32(2)(b)(ii) and/or (iii) of Directive 2014/24/EU (regulations 32(2)(b)(ii) and (iii) of the Public Contracts Regulations 2015) as the database is the only one which provides DSTL with the breadth and depth of scientific information it requires to service the needs of its customers and only IHS Markit have the proprietary rights to provide subscriptions to it.
