OJEU 2018 Procurement Thresholds – What’s Changed?

 

The new OJEU Procurement Thresholds for 2018 have been announced.

The value thresholds for contract opportunities that must be advertised in the Official Journal of the European Union (OJEU)  changed on 1 January 2018.

Public sector bodies are legally required to follow the European procurement process.

The new OJEU Procurement Thresholds for 2018 are given below.

Changes from the 2016-17 thresholds are marked in red.

The Public Contracts Regulations

The European Public Contracts Directive is transposed into UK law by the Public Contracts Regulations 2015 and the Procurement (Scotland) Regulations 2015. It governs the procurement activities of public sector bodies including government departments, local authorities and NHS Trusts.

The Defence & Security Public Contracts Regulations

The Defence & Security Regulations 2011 currently apply to entities operating in the fields of defence and security. The specialised nature of the market means that specific thresholds have been created for this sector.

The Utilities Contracts Regulations

The Utilities Contracts Regulations 2016 and Utilities Contracts Regulations (Scotland) 2016 apply to certain utility companies operating in the energy, water, and transport sectors.

The Concession Contracts Regulations 2016 and Concession Contracts Regulations (Scotland) 2016 govern contracts under which a contracting authority or utility outsources works or services to a company which has the right to commercially exploit the works or services to recoup its investment and make a return.

What authorities must follow European procurement law?

The new thresholds apply to all contracting authorities, as defined by the Public Contracts Regulations 2015. This includes:

  • Central government departments
  • Non-Departmental Public Bodies
  • Executive Agencies
  • Wider public sector organisations

 

What’s changed?

Procurement experts have described this threshold change as “uneventful”. There have been minimal increases in some euro and sterling values. In other cases, the euro value remains unchanged while the sterling values have changed slightly to reflect the weaker position of the pound.
