This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
Solicitation Number W15QKN-17-Q-1036 is issued as a request for quotation (RFQ). This solicitation document incorporates provisions and clauses of those in effect through Federal Acquisition Circular 2005-95. This is a 100% Small Business Set-Aside. The associated North American Industrial Classification Standard (NAICS) Code is 312112, size standard is 1,000 employees.
The Army Contracting Command – New Jersey (ACC-NJ) intends to award a Firm Fixed Price contract for the purchase of nine thousand one hundred (9,100) gallons of bottled water in accordance with the Statement of Work (SOW) entitled “Bottled water Delivery Service”, dated 22 March 2017. The bottled water shall be delivered at Building 1686, Fort Pickett, VA. The delivered bottled water shall total 9,100 gallons with deliveries of 3,100 gallon on first delivery and 3,000 gallons on following deliveries during the period starting 16 May 2017 to 28 June 2017.
The Government intends to award a firm fixed price contract resulting from this Solicitation. The Contractor shall be capable of performing all requirements of the SOW in order to be considered technically acceptable. Award will be made to the offeror who submits the lowest priced, technically acceptable quote, and is deemed responsive and responsible by the Contracting Officer. The Contractor must have the ability to provide all required items in order to be deemed technically acceptable. Your Technical Proposal must contain a Capabilities Statement to include a technical approach which states how you will meet the requirements of the SOW. The Contracting Officer reserves the right to make no award under this RFQ.

Pricing shall be submitted in the proper format. The proper format consists of QUANTITY x UNIT PRICE = TOTAL AMOUNT. In the event there is a difference between a unit price and the extended total, the unit price will be held to be the intended price. If the offeror shows only the total price but fails to enter a unit price, the total divided by the estimated quantity will be held to be the intended price.
Quote should include FOB DESTINATION PRICING; freight should not be listed separately. Line Item pricing should include all applicable taxes, fees, gratuities, commissions, services charges, etc. NOTE: The Federal Government is tax exempt.

52.212-2 EVALUATION–COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Proposal Evaluation will be Lowest Price, Technically Acceptable. Technical Acceptability is defined as meeting the requirements of the PWS and Price is lowest overall price when all line items are summed. Your Technical Proposal must contain a Capabilities Statement to include a technical approach which states how you will meet the requirements of the PWS, to include availability/quantity of manpower/hours and equipment to perform this effort. Capabilities statement/technical approach shall be no more than 2 pages in either Microsoft Word or Portable Document Format (PDF).
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

REQUIREMENTS FOR CONTRACTOR EMPLOYEES
(a) All contractor employees requiring access to any Federally-controlled facility and logical access to Federally controlled information systems except for “national security systems” as defined by 44 U.S.C. 3542(b)(2), should be certified in Level 1 Anti-Terrorism Training. The training is accessible from any computer with access to the World Wide Web and is available at https:/atlevel1.dtic.mil/at. The contractor is responsible for ensuring that the training has been satisfactorily completed and that valid certificates of completion have been submitted to the Contracting Officers Representative (COR) with a copy furnished to the Contracting Officer. The Certificates are valid for one year; therefore, training shall be completed every year for the duration of the contract.
(b) The term Federally-controlled facility is defined as:
(1) Federally-owned buildings or leased space, whether for single or multi-tenant occupancy, and its grounds and approaches, all or any portion of which is under the jurisdiction, custody or control of a department or agency;
(2) Federally-controlled commercial space shared with non-government tenants. For example, if a department or agency leased the 10th floor of a commercial building, the Directive applies to the 10th floor only;
(3) Government-owned, contractor-operated facilities, including laboratories engaged in national defense research and production activities; and
(4) Facilities under a management and operating contract, such as for the operation, maintenance, or support of a Government-owned or Government-controlled research, development, special production, or testing establishment.
(c) The term “Federally-controlled information system” means an information system (44 U.S.C. 3502(8) used or operated by a Federal agency, or a contractor or other organization on behalf of the agency (44 U.S.C. 3544(a)
(d) The term “contractor employee” includes employees, agents, students or student interns, or representatives and all employees, agents or representatives of all subcontractors and suppliers.

(a) Definitions. As used in this clause–
Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall–
(1) Have a designated electronic business point of contact in the System for Award Management at ; and
(2) Be registered to use WAWF at following the step-by-step procedures for self-registration available at this Web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through

ACCESS TO INSTALLATION
The Contractor will ensure that personnel have proper identification for entry into the Fort Pickett, VA. All employees must have a picture ID to gain access on base, or the employer will have to wait at the gate entrance to identify those with no picture ID.
The Contractor will ensure that personnel operating privately owned vehicles on the installation shall have a valid state license to operate a motor vehicle and shall comply with the current Fort Pickett Standard Operating Procedures. At any time the Fort Pickett police can inspect their vehicles. (Contractor is responsible to ensure all his employees have current vehicle insurance while operating them on Fort Pickett).
Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
